Terms of Service

1. Introduction
Kinesia operates the Kinesia platform, which includes the mobile application, the web portal at my.kinesia.app, the patient portal at patient.kinesia.app, and related services (collectively, the "Service").
By accessing or using Kinesia, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Service Description
Kinesia is a practice management platform designed for physiotherapists, chiropractors, osteopaths, and other rehabilitation professionals. Core features include:
- Exercise program creation and management
- AI-assisted program generation from clinical notes
- Exercise video recording and library management
- Patient portal for program delivery and progress tracking
- Clinic branding and customisation
- Team management and multi-clinician collaboration
Kinesia is not a medical device. The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. Kinesia is not a substitute for professional clinical judgment, and it is not regulated under medical device legislation in any jurisdiction.
3. Account Registration
To use Kinesia, you must create an account and provide accurate, complete information during registration. You are responsible for:
- Maintaining the accuracy of your account information
- Keeping your account credentials secure and confidential
- All activity that occurs under your account
Accounts are for individual use only. Each person must have their own account, and accounts may not be shared with or transferred to another person.
4. Subscription & Billing
New accounts receive a 30-day free trial with full access to all features. No payment information is required during the trial.
After the trial period, a paid subscription is required to continue creating new content (programs, exercises, templates). Your existing data — including programs, patient records, and patient portal access — remains fully accessible without a subscription.
Subscriptions are billed monthly or annually through Stripe. Current prices are listed on the subscription page at my.kinesia.app.
Auto-renewal: Subscriptions renew automatically at the end of each billing period. You can cancel your subscription at any time through the subscription management portal at my.kinesia.app. When you cancel, your access to paid features continues until the end of your current billing period.
Price changes: Kinesia may change subscription pricing with at least 30 days' notice. If you are an active subscriber at the time of a price change, your current rate will remain in effect until you cancel or your billing period renews after the notice period has elapsed.
Refunds: We do not offer refunds for partial billing periods. However, we may make exceptions at our discretion for reasonable requests. Contact us at hello@kinesia.app if you believe a refund is warranted.
5. Acceptable Use
When using Kinesia, you agree not to:
- Share your account credentials with others or allow unauthorised access to your account
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble any part of the Service
- Upload malicious content, including viruses, malware, or other harmful files
- Interfere with or disrupt the Service's infrastructure or other users' access
- Exceed reasonable usage patterns, including automated account creation, excessive API calls, or scraping
You must not use Kinesia to store information about minors without appropriate parental or guardian consent as required by applicable law in your jurisdiction.
6. Data Ownership & Licence
You retain full ownership of all content you create using Kinesia, including exercise programs, clinical notes, video recordings, exercise templates, document attachments, and patient data.
By using the Service, you grant Kinesia a limited, non-exclusive licence to process, store, and transmit your content solely for the purpose of providing and maintaining the Service. This licence ends when you delete your content or your account.
Kinesia does not sell your data, use it for advertising, or share it with third parties except as necessary to operate the Service (see our Privacy Policy for details).
7. AI-Generated Content
Kinesia uses artificial intelligence (powered by Anthropic Claude) to generate exercise programs, patient education documents, and related clinical content.
AI-generated content is a clinical suggestion, not medical advice. You are solely responsible for reviewing, modifying, and approving all AI-generated output before prescribing it to patients. You should exercise the same professional judgment with AI-generated content as you would with any other clinical resource.
When clinical notes are sent to the AI for program generation, they are anonymised before submission. No patient names, identifiers, or personal information are included in AI requests. The AI receives only clinical observations, body regions, and exercise preferences.
AI-generated content may contain errors, omissions, or clinically inappropriate suggestions. Kinesia is not liable for any clinical outcomes resulting from the use of AI-generated content.
8. Patient Data
As a clinician using Kinesia, you are responsible for obtaining any consent required by applicable law from your patients before entering their personal information into Kinesia and sharing exercise programs with them.
Patient data entered by clinicians — including patient names, email addresses, and phone numbers — is used solely for the purpose of delivering exercise programs and related communications (such as reminders and progress notifications).
Patients access their exercise programs through a secure portal using one-time email verification codes. No patient accounts or passwords are created.
9. Availability & Support
Kinesia aims to maintain high availability of the Service but does not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Where possible, scheduled maintenance will be communicated in advance. We will make reasonable efforts to minimise disruption.

10. Limitation of Liability
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, Kinesia's total aggregate liability to you for any claims arising out of or related to the Service is limited to the total amount you paid to Kinesia in the twelve (12) months immediately preceding the event giving rise to the claim.
Kinesia is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of profits, or damages arising from clinical outcomes, even if Kinesia has been advised of the possibility of such damages.
11. Account Termination & Deletion
You may delete your account at any time from the mobile app or web portal. Account deletion permanently removes all your data, including programs, exercises, video recordings, exercise templates, document attachments, patient records, and clinic information. Patient portal links associated with your account will stop working.
Kinesia may suspend or terminate your account if you violate these terms or abuse the Service. Where practicable, we will provide notice before termination.
Following termination or deletion, your data is retained for 30 days before permanent deletion to allow for reconsideration. After the 30-day retention period, all data is permanently and irreversibly removed.
12. Modifications
Kinesia may update these Terms of Service from time to time. When we make material changes, we will notify you via email at the address associated with your account.
Your continued use of the Service after receiving notification of changes constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using the Service and delete your account.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada.
